Follow-up to the Final Statement regarding FNV vs. Just Eat Takeaway.com
On 23 July 2025, the Dutch National Contact Point published a Follow-up regarding the notification submitted by FNV against Just Eat Takeaway.com. The notification concerned alleged non-compliance with the OECD Guidelines concerning freedom of association and due diligence responsibilities at a subsidiary in Israel.
Previously, the NCP had accepted the notification for further consideration (see Initial Assessment) and offered to facilitate a dialogue between FNV and the company. While FNV accepted the offer, Just Eat Takeaway.com declined, hence no dialogue took place. The NCP subsequently examined the notification and issued a Final Statement on 22 March 2023, concluding that the company had not acted in accordance with the OECD Guidelines.
Following the publication of the Final Statement, a newspaper article suggested that the company did not intend to follow the NCP’s recommendations. This prompted a meeting between the company and relevant government officials.
The recently published Follow-up shows that Just Eat Takeaway.com has not implemented all recommendations, including engaging with FNV regarding the parent company’s responsibilities, and facilitating meaningful dialogue between its subsidiary and the local trade union. The company claims to have implemented other recommendations - such as improving internal communication on freedom of association and updating relevant policies - but the NCP has not verified these claims.
