The Follow-up to the Final Statement concerning the ATUMA notification against Unilever was published on 8 December 2025. A Follow-up shows what parties have done with the agreements and/or recommendations from the NCP’s Final Statement.
The notification concerned alleged violations of the OECD Guidelines related to the dismissal of 802 employees at the subsidiary Marsavco/PHC in the DRC in 2001. The NCP accepted the notification and offered mediation. This mediation ended in September 2023 without agreement between the parties.
In its Final Statement, the NCP recommended that Unilever evaluate its approach to responsible disengagement and bring it in line with the OECD Guidelines. The NCP therefore welcomes Unilever’s development of internal disengagement guidelines, but has not been able to verify whether these are in line with the 2023 OECD Guidelines. The NCP notes that no changes have been made to Unilever’s policy for participating in future NCP procedures by adopting a less legalistic approach. The NCP regrets that the process has not led to a resolution of the underlying issues raised in this notification.
