Following the submission Migrant Justice vs. Ahold Delhaize, the Dutch National Contact Point (NCP) published an Initial Assessment (IA) on 22 May. Various (social) media posts have since appeared that contain incorrect information about the NCP, the NCP procedure, the status of the submission and the role of the Dutch government.
The NCP operates independently from the government and is responsible for handling submissions. Any suggestion that this concerns a decision by the Dutch government is incorrect. The current status of the submission is that, on the basis of formal OECD criteria, the NCP has accepted it for further consideration. At this stage, the NCP does not conduct any investigation. The NCP’s acceptance of this submission in no way constitutes a judgment on the accuracy of its content, nor on whether the company has complied with the OECD Guidelines.
